Terms of service

The agreement between you and us when you buy a recording here. Written in plain English, because you should be able to read it before you agree to it.

Draft, pending legal review

This document has not yet been reviewed by an Australian lawyer, and the business details it refers to are placeholders. It is published so the wording can be checked, and it should not be relied on until the review is complete.

1. Who you are dealing with

OnHoldMusic.ai is operated by [Registered entity name — to be supplied], ABN [ABN — to be supplied] (“we”, “us”, “our”). These terms apply when you use this website and when you buy a recording from us.

By placing an order you accept these terms. If you are ordering for a business, you confirm you are authorised to accept them on its behalf, and “you” means that business.

2. What we provide

We produce telephone audio: music on hold, welcome greetings, after-hours messages, menu prompts and voicemail greetings. You write a script, with help from our AI assistant if you want it, choose an Australian voice and a music style, hear a short preview, and after payment download the finished recording in the formats your phone system needs.

What we deliver is a set of digital files. We do not supply phone lines, hardware or installation, and we do not configure your phone system. If a file will not load, tell us and we will help you work out why.

3. The voices are synthesised

Every voice in our catalogue is produced by speech synthesis in an Australian accent. No human voice actor reads your script, and the voices are not the voices of real people. The voice you hear in the preview is the one used for the finished recording.

Synthesised speech occasionally mispronounces a name, an abbreviation or a place. If yours comes out wrong, tell us and we will correct it and produce the recording again at no charge.

4. One purchase, one recording

Each purchase covers one recording. There is no subscription, no monthly fee and nothing to cancel. If your hours, services or staff change later, a new version is a new recording at the price shown at that time.

Current prices are on the pricing page. Prices are shown in Australian dollars (AUD) and include GST. Payment is handled by Stripe. We do not receive or store your card details. Your order is paid when Stripe confirms the payment to us, which is normally immediate.

5. The preview, then the recording

Before you pay you can hear a preview of your own audio: your words, in the voice you chose, with the music you chose, mixed the way the finished recording will be. The preview is a sample and is limited to five seconds. The complete recording is produced after payment, not before.

You can change the script, the voice and the music as often as you like before you pay, and take a new preview each time. Once payment is confirmed the complete recording is normally ready within a few minutes, and you can download it as often as you need.

6. Your licence to use the recording

When we have received payment in full, we grant you a perpetual, worldwide, non-exclusive licence to use the recording we deliver in your own business, including commercially. That covers:

  • playing it to callers on hold, as a greeting, as a menu prompt or as a voicemail message;
  • using it on every phone number, extension and location of the business that bought it;
  • giving the file to your phone provider, IT contractor or installer so they can load it for you;
  • keeping and using it after you stop using this service.

You keep whatever rights you already had in the words of your script. We do not claim them, and we do not sell your script or your recording to anyone else. We keep ownership of the delivered recording itself, of the voice models, and of any library music used to make it.

Where a recording includes music from our library, that music is commercially licensed for use through this service. The licence we grant covers that music only as part of the recording we deliver to you.

If we refund an order, the licence for that recording ends. You will need to stop using it and delete the files.

7. What you may not do with it

  • Sell, sublicense or distribute the recording as a product, or as part of a product, service or library you supply to others.
  • Separate the music from the recording, or use the music bed in anything else.
  • Use the recording for a business other than the one it was made for, or pass it to another business to use as its own.
  • Present a synthesised voice as a real person, or as an endorsement by a real person.
  • Use the recording for anything unlawful, misleading or deceptive.
  • Copy, scrape or reverse engineer the service, or use it to build or train a competing product, voice or dataset.

8. Your script, and your responsibility for it

You supply the words, and you are responsible for them. By ordering you confirm that:

  • you have the right to use every business name, trade mark, brand and product name in the script;
  • anything the script says about your prices, availability, qualifications, licences, guarantees or turnaround is accurate and not misleading, as the Australian Consumer Law requires;
  • wording that is regulated in your industry — health, legal, financial services, credit or migration advice among them — meets the rules that apply to you;
  • personal information about other people, such as a staff member’s name or direct number, is included with their knowledge.

We may decline to produce a recording, or stop supplying one, if the script breaks these terms or the law. Where we do that before the recording is produced, we refund what you paid for it.

9. The assistant drafts, you decide

The script assistant is a drafting tool. It is quick, and it is sometimes wrong: it can invent a detail, misread a website, or phrase something in a way that does not suit you. Read what it wrote before you buy. The recording is made from the script as you approved it, and the words in your preview are the words you will get.

If you ask us to read your website, you confirm that you own it or are authorised to use its content. We fetch a small number of pages and use what they say as background facts for the draft. That text is treated as information about your business, never as instructions to us.

10. Acceptable use

Do not use the service to produce content that is unlawful, defamatory, harassing, discriminatory or obscene, or that is designed to deceive a caller — impersonating another organisation being the obvious case. Do not try to work around the limits on the service, whether by automation, by many sessions or otherwise.

We may suspend or decline service where these terms are broken. If we do that before producing a recording you have paid for, we refund it.

11. Availability

We work to keep the service running and to produce recordings quickly, but we do not guarantee that the site will be available at any particular time. It may be interrupted by maintenance, by a fault, or by an outage at one of the providers we depend on. If a fault stops you downloading a recording you have paid for, tell us and we will get it to you.

12. If something is wrong with your recording

Our refund policy explains what happens when a recording is faulty, is not what we described, or otherwise falls short, and how to ask us to fix it. It forms part of these terms.

13. Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a replacement or a refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services put right if the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies those rights or any other right you have under that law.

Subject to that, and only to the extent the law allows:

  • our total liability for any claim connected with the service or a recording is limited, at our option, to supplying the recording again or refunding what you paid for it;
  • we are not liable for indirect or consequential loss, or for lost profits, lost business or lost goodwill;
  • we are not liable for loss caused by the content you supplied, by the way the recording is used, or by the way your phone system is configured or operated.

14. Privacy

Our privacy policy explains what personal information we collect, why, who we share it with and how to reach us about it. It forms part of these terms.

15. Changes to these terms

We may update these terms. The version published when you place an order is the version that applies to that order, and the effective date of the current version is shown at the top of this page.

16. Governing law

These terms are governed by the laws of [State or territory — to be supplied], Australia, and you and we submit to the courts of that place. This does not affect any right you have to bring a claim under the Australian Consumer Law, or in the place where you live or carry on business.

17. How to contact us
